S&W Recall of The Popular Shield EZ

M&P SHIELD® EZ® PISTOL IMPORTANT SAFETY RECALL NOTICE FOR PISTOLS MANUFACTURED BETWEEN MARCH 1ST, 2020 AND OCTOBER 31ST, 2020
Smith & Wesson has identified two M&P Shield EZ Pistols on which the hammers manufactured by our supplier were cracked. In those firearms, the hammer failed to fully engage the sear, causing the round to fire, cycling the slide, and potentially resulting in multiple discharges without depressing the trigger. This issue can occur in the following two scenarios:

With a loaded magazine in the firearm and the grip safety depressed, releasing the slide (by pulling it back, or releasing the slide stop), may ignite the round as the slide closes, without engaging the trigger. The condition may occur, regardless of the manual thumb safety position if equipped. This may also result in multiple discharges.
With a loaded magazine in the firearm, the grip safety depressed, manual safety in the fire position, slide closed, and a round in the chamber, pulling the trigger will cause the round to fire normally, however as the slide cycles, the next round may be ignited as it is chambered by the hammer failing to fully engage the sear, causing multiple discharges.

In all cases, the firearm will NOT fire unless the grip safety is depressed. While this condition has been found only in two hammers, and our investigation suggests that these two incidents are very isolated, any unintended discharge of a firearm has the potential to cause injury. Therefore, we have established this Safety Recall as a precautionary measure to ensure that all M&P Shield EZ Pistols in service meet our design specifications.

Duty To Retreat in Colorado

Search the Web and you will quickly find that Colorado is not a statutory stand your ground state. Stand your ground means no duty to retreat. What that means is we don't have a stand your ground law like Florida does. BUT we do have case law since 1876 (when we became a state) and that case law says we treat people just like stand your ground states do. There have been many cases on the duty to retreat.

Colorado law allows a person to use deadly force in defense of themselves or another without needing to retreat first. The Colorado Supreme Court held that neither the self-defense statute nor Colorado common law required a person who is not the aggressor and entitled to use deadly physical force in self-defense to retreat before using such force. (People v. Toler, 9 P.3d 341 (2000), citing Boykin v. People, 45 P. 419 (Colo. 1896).

In Colorado, per the Supreme Court decision above, a person does not have to retreat before using force regardless of whether they are in a place they have a right to be. All that is required is that a person is facing an imminent threat, they did not provoke unlawful use of force, they were not the initial aggressor (or if they were, that they communicated their withdrawal from the conflict), and that they were not involved in unlawfully agreed combat.

Remember if you ignore the chance or an obvious way to retreat and pull your handgun when you had other choices. You may find yourself in trouble!

Guns In Cars Same Old Story

The Holidays are approaching and we are more likely to leave attractive items in our automobiles for thieves.

Remember to lock your guns in your car safe when you leave your gun in your car. We are seeing a lot of guns stolen from cars in our area. People are leaving guns in autos and are losing those guns to thieves.

We all have handguns with us much of the day and sometimes that means having to leave it in the car when we go to a non-permissive place.

The most popular places to keep your guns according to the police reports we have seen are Under the Seat - The Glove Box- and The Center Console. These locations in your car are not safe.

I have safes available that are inexpensive and easy to use with most guns and they make great presents for the holiday. These safes simply attach to the frame of the seat and in less than 2 minutes they are installed and in use. In addition these safes are TSA approved to fly with. Let me know if I can help you keep your firearm secure.

Free Gun Cleaning Class January 2021

You should all understand that there are many ways to clean your handgun and they are probably all better than not doing it at all. I am teaching the way I have always done it. The idea is to get all the leftover grunge from the firing cycle out of your gun and to lubricate it so that it runs properly and does not malfunction on you when you need it the most. Many of the modern handguns that we own could probably be fired literally hundreds of times with no cleaning and probably never hiccup even once.
But do we want to take that chance? I personally do not like to carry a fired gun for self-defense. Do I clean my guns after every firing? No many times I don't, but if I fire my everyday carry (EDC) handgun then I always try to clean it right away. Cleaning a gun is like many things in the firearm industry there are a million ways to do it. There is not just one correct way. Find a way that is easy for you and maintain your firearm so that it will work when you need it the most.
Do not go out and buy a cleaning kit......You will want to see what I recommend you get, and I will have some inexpensive cleaning items for sale during these events. January 12th and 13th, Tuesday and Wednesday evenings at 6:30 pm in my classroom. If these dates do not work for you let me know what does and I will try to arrange something different.
