concealed carry online trainingI have seen a recent increase in people coming to me with the sad story of spending their money on concealed carry online training only to find out that it is not acceptable in Colorado.

First– Colorado adopted a law in 2013 stating that concealed carry online training was not appropriate and that it was not allowed under our concealed carry laws in Colorado. Some confusion was had when the NRA came out with a training module that was done online, the difference being that you had to seek out a certified instructor to finish the class in person. This was allowed under the law because you had part of the training with a live person and that was an exception in the statute.

New Colorado Law Bans All Online Training

C.R.S. § 18-12-202(5)

“handgun training class” does not include any firearms safety course that allows a person to complete the entire course:

(I) Via the internet or an electronic device; or

(II) In any location other than the physical location where the certified instructor offers the course.

Second– Concealed Carry Training is not something you get out of a cereal box.  You need to not only discuss the laws of the state you will be carrying in, but you should have some hands-on training with a firearm so that you know the proper and safe methods of handling your firearm on a general basis especially under stress. Very few people come to me with what I call appropriate knowledge to be able to administratively handle their firearm and do it safely. I recently had a person in a class that had just taken another basic course from a certified instructor in the Pueblo Colorado area. This student informed me that they were not taught any of the safe handling techniques I use in my classes.  I find this especially troubling since most firearms accidents happen when administratively handling the handgun (loading and unloading). I also have witnessed instructors with students on the firing line where the student can not administratively handle that firearm safely in the shooting booth. This truly worries me that people are not getting some of the most important primary training they need. Its no wonder that concealed carry online training was not allowed under Colorado law.

Colorado Concealed Carry Renewal TrainingThis year I’m seeing a big surge in Colorado concealed carry renewal training because I think people are finally realizing that they may not have gotten the training they needed to safely carry a concealed handgun when they first got their permits. If you have gone more than 5 years without some concealed carry renewal training you are kidding yourself. I am teaching material I have learned in the last year. Being an instructor is a commitment to training and being a student forever. Part-time instructors, gun show classes, hotel classes, and a class at the church may or may not have given you what you need to stay out of trouble and survive a deadly encounter.

Let’s face it the chances of you using your gun in self-defense is slim and none. Thank god Self Defense shootings are rare. Most shootings that you hear about are gang-related or involve the police or some criminal activity. The chances that you will injure yourself or someone else administratively mishandling your own gun is really high. Transporting your gun, loading and unloading that self-defense ammo because its expensive and you don’t want to waste it at the range. Cleaning your gun, and the big one drawing from the holster and then re-holstering and carrying a gun either improperly or in the wrong holster, these are all activities where accidents happen and concealed carry renewal training can help.

Next, the level of understanding of the allowed use of deadly force amazes me. I had a conversation with a couple in a renewal class the other day and I was floored at the level of misinformation most concealed carry holders actually have. People believe they can do all kinds of things with their gun in and out of their home that is not proper. Then there are the state gun laws that have not changed much in the 10 years I’ve been involved in this arena. But there are places now in Colorado that have preempted Colorado State law and made up their own regulations and guess what, you have to follow them and ignorance is not an excuse. Yes, there are lawsuits filed on these laws but it will take years to figure it out and meanwhile, you are subject to these rules. I remember a time when the rules were the same everywhere in Colorado that made you confident about having a gun and knowing what was right and wrong throughout the state.

On top of all that traveling out of the state of Colorado with a gun in your car has gotten trickier and trickier. Do you carry insurance for this you should if you don’t. Do these things sound important to you? Important enough to get someone to tell you the real scoop. Can you safely access your gun and put shots on target under stress? Can you draw your handgun sitting down? Have you practiced shooting your gun at contact distances? Have you tried to practice pulling your firearm while in your car? You know most self-defense incidents happen within 10 feet are over in less than 3 seconds with 3 or fewer shots being fired, and happen frequently in and around automobiles.

Concealed Carry Restrictions

The License is for Concealed Carry

There are some confusing signs in the Pueblo area that restrict your right to carry a concealed weapon. Some of the signs are on public or county properties and they are very visible. The first one that we have all seen says The Open Carrying of Firearms Or Deadly Weapons Within This Building Is Prohibited”   this sign is straightforward. You can not carry a gun that is exposed (open carry) like the cowboys did in the old days in this building. Concealed Carry is fine but it has to be concealed. The Confusing part of this sign is when it shows up somewhere that you can’t carry at all, like the 10th judicial court building where they have metal detectors and sheriff officers guarding the entrance.

The next one is a little tricky and people have told me that is says something different than it actually does. “Bringing in concealed weapons that are not legally licensed and permitted, or openly displaying a weapon except by law enforcement officials is prohibited”  this sign has two parts separated by a comma. The first part says you can’t bring a concealed weapon in unless it is licensed or permitted. The second part says no open carry except by law enforcement. These type of  Concealed Carry restrictions or notices are common. The problem ensues when a person doesn’t read the entire sign and really dissect what the meaning or intent is from the sign.

Remember it is your responsibility as a licensed concealed carry individual to know and understand all the restricted areas that you encounter in your normal travels around town,  restrictions apply but are not limited to, the Jail, Post Office, Court, Schools, Airports,Public Transportation(Bus),Colorado State Fair Grounds, and any place that has a metal detector or a sign posted with some restrictions.

The Pueblo City Ordinance  11-1-601 is very clear on the subject. It defines all the things you should not do and then tells you what you can do. Things like knife blade lengths and stun guns are discussed. If you live in the Pueblo area you should read this ordinance so that you are informed.

Bank signs vary from location to location. One of the things that always comes up is the fact that no gun signs in Colorado have no force of law. What that means is that Colorado, unlike some other states, has some very weak language in their sign law.  So it has been said that in these locations all that can happen to you if caught with a firearm is to be asked to leave. If you refused you may be able to be charged with trespassing.  Timothy J. Priebe, Esq. an attorney in Colorado has written a paper called Should I Stay Or Should I Go where he discusses this issue. You should read and understand this document.

Bank Sign TexasThis sign is on one of the local banks in downtown Pueblo, Colorado it is totally bogus. This sign is the Texas Law 30-06 and these laws do not exist in Colorado. This bank just thinks most people will follow whatever sign they post or that gun owners are sheep.

In many of my classes I talk about the importance of knowing when you can and can’t use deadly force. The attorney’s from U.S.Law Shield discuss this situation in many of the classes they hold. A person may use deadly force if a lesser degree of force is inadequate. A person does not have to retreat before using force regardless of whether they are in a place they have a right to be. All that is required is that a person is facing an imminent threat, they did not provoke unlawful use of force, they were not the initial aggressor.

Concealed Carry USPS

Concealed Carry Not Allowed in Federal Facilities

The federal government prohibits firearms in federal facilities (which includes post offices, IRS offices, etc.).
Violating this prohibition may result in federal charges, and imprisonment up to a year.
However, this prohibition does not extend to post office parking lots. In July of 2013, U.S. District Court Judge Richard Matsch ruled that the previously enforced USPS regulation that extended a ban on firearms to USPS parking lots, was not constitutional.

The term “Federal Facility” means a building or part thereof owned or leased by the Federal Government, where Federal employees are regularly present for the purpose of performing their official duties.
This would include federal court houses, IRS offices, Post Offices, Ranger Stations and other buildings in Federal Parks, etc.

Concealed Carry

This is great news for most of us that have been trying to comply with a law that was very unreasonable. Remember that Concealed Carry is NOT PERMITTED in the Post Office and other Federal Facilities.

Remember that as a Concealed Carry Permit holder it is your obligation and responsibility to keep up to date on the Concealed Carry laws for your state, and the Concealed Carry laws of any state you might travel to with your firearm.
